Good to know

A suit for restitution asks the court to direct a spouse to resume married life. It is usually filed when one spouse has left the home without lawful reason.

Many family disputes settle at the pre-trial stage. A well-drafted settlement can resolve Mehr, dowry, maintenance and custody together.

Protect your case

Common mistakes to avoid in a family dispute

Waiting months without action

Instead: Note the date of separation and send a legal notice early.

Using threats or force

Instead: Pressuring a spouse to return is unlawful and damages your case.

Ignoring a case against you

Instead: Respond on time — courts can decide ex-parte if you don't appear.

Settling only by word of mouth

Instead: Put every term in writing, or have it recorded before the court.

Restitution & settlement FAQs

Can the court force my spouse to come back?

A decree directs the spouse to resume married life, but no one can be physically compelled. The decree can still carry weight in related matters, such as maintenance.

Is a family settlement legally binding?

A settlement recorded before the court, or properly drafted in writing, can be relied on later. We make sure the terms are clear and enforceable.

My wife has filed for Khula. Can I respond with restitution?

It depends on the facts. We review the claim and advise on the most realistic response, including settlement where it serves you better.

How much does it cost?

Consultation is free. Fees depend on whether the matter settles or goes to trial — you get a written quote first.
