Good to know

The child's welfare is the deciding factor. Mothers are often preferred for young children, but the court looks at each child's needs, age and circumstances.

The parent without custody normally gets a meeting schedule, and the father usually remains responsible for maintenance.

Common mistakes to avoid in a custody case

Taking the child without an order

Instead: Self-help can backfire in court. Seek interim custody through the proper process.

Criticising the other parent to the child

Instead: Courts focus on welfare. Keep messages calm and respectful — they may be evidence.

Not keeping records

Instead: Save school reports, medical bills and messages about the child's care.

Stopping visits on your own

Instead: Follow existing orders, even when it's hard. Ask the court to change them instead.

Child custody FAQs

Who gets custody of the children after separation?

There is no automatic answer. The Family Court decides based on the child's welfare, looking at age, care, education and each parent's situation.

Does a mother lose custody if she remarries?

Not automatically. Remarriage is one factor, but courts still decide on what is best for the child.

The other parent won't let me see my child. What can I do?

You can apply to the court for a visitation schedule. If an existing order is being ignored, we can seek its enforcement.

How much does a custody case cost?

Consultation is free. Case fees depend on whether the matter is contested — you get a written quote first.
